1. Who we are and what these terms cover

Market Sensus ("Market Sensus", "we", "us", "our") is a subscription tool that compiles and displays insurer investment-linked fund prices and related reference information, with charting, watchlist and historical-performance features, for licensed financial advisers and industry professionals. These Terms and Conditions ("Terms") govern your access to and use of Market Sensus (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for licensed financial advisers and industry professionals aged 18 or over. By using it you confirm that you are at least 18, are using it in a professional capacity, and are authorised to do so under your own licence, your employer's policies, and your regulatory obligations. The Service is reference data and tooling only; it does not relieve you of any of those obligations.

3. Your account and acceptable sharing

Your Market Sensus login is personal to you and licensed for your sole use. You must not share, sell, sublicense, transfer, or disclose your username, password, or one-time verification codes, or let anyone else access the Service through your account. Each subscription entitles one named user; additional users require their own subscriptions.

You are responsible for keeping your credentials and authenticator device confidential and for all activity under your account. Tell us immediately of any unauthorised use. We use security measures including two-factor authentication and a per-user watermark (your email is displayed faintly over the data) to help trace leaks. We may suspend or terminate accounts that show signs of shared or concurrent use — for example simultaneous logins from multiple locations, or an unusual number of devices or IP addresses — with or without notice.

4. Acceptable use

You must not: - redistribute, republish, resell, scrape, bulk-export, or systematically copy data obtained through the Service; - circumvent or attempt to circumvent access controls, watermarking, rate limits, or security measures; - use the Service to build or train a competing product or dataset; - remove, obscure, or alter the watermark or any proprietary notices; - use the Service unlawfully or in breach of any third party's rights or terms.

Data accessed through Market Sensus is for your own professional reference only.

5. The data — accuracy and "not advice"

Fund prices and figures are compiled from insurer and other third-party sources and provided for reference only. They may be delayed, restated, incomplete, or contain errors. Derived figures — for example period returns and the synthesised weekly/monthly candlesticks — are calculated by us from daily prices and are not official or insurer figures; they illustrate trends and volatility, not exact intraday values.

Nothing in the Service is financial, investment, tax, accounting, or legal advice, a recommendation, an opinion on suitability, or an offer or solicitation. It does not take account of any person's objectives, financial situation, or needs. You are solely responsible for any decisions made using it and for meeting your own regulatory and suitability obligations. Always verify a figure against the official source before relying on it or using it with a client. See our separate Investment & Data Disclaimer, which forms part of these Terms.

6. No affiliation with insurers; source data

Market Sensus is independent and is not affiliated with, endorsed by, sponsored by, authorised by, or otherwise connected to any insurer, fund manager, or data provider. All product, fund, and company names that may appear in the Service are trademarks of their respective owners and are used for identification and reference only.

Fund prices and related figures originate from insurers' published sources. Those source providers assert their own intellectual property rights over that data and publish their own disclaimers, terms of use, and privacy notices, which prevail over these Terms in respect of the source data. The Operator claims no ownership of, or affiliation with, that underlying source data.

8. Privacy and client confidentiality

We process your personal data (including name, email, login, and billing information) in accordance with our Privacy Policy and Singapore's PDPA. Do not enter your clients' personal or confidential data into the Service — it is not designed to hold client information, and doing so may breach your own confidentiality and data-protection obligations.

9. Intellectual property

The Service, its software, design, look and feel, and the compiled database are owned by the Operator or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service during your subscription for your own professional reference. Underlying source data remains subject to the rights of the originating providers. No rights are granted except as expressly stated.

10. Availability and changes to the Service

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and may modify, suspend, or discontinue features. Insurers value funds on each business day and publish bid/offer prices with a lag (often after the next business day); the Service reflects those published prices and may therefore lag both the pricing date and the source. Prices and figures may be unavailable, delayed, or incorrect at times. See the Investment & Data Disclaimer for how figures are produced.

11. Suspension and termination

We may suspend or terminate your access for breach of these Terms (including account sharing or misuse), non-payment, or where required by law or our own regulatory obligations. You may cancel at any time. Provisions that by their nature should survive — intellectual property, disclaimers, limitation of liability, and governing law — survive termination.

12. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law, including any implied warranty of accuracy, merchantability, or fitness for a particular purpose. To the maximum extent permitted by law, the Operator is not liable for any indirect, incidental, special, or consequential loss, or for any loss or damage arising from reliance on the data or from any decision made using the Service; and our total aggregate liability is limited to the fees you paid in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under Singapore law.

13. Indemnity

You agree to indemnify the Operator against claims, losses, and costs arising from your breach of these Terms, your misuse of the Service, or your use of the data with clients in breach of your own regulatory or confidentiality obligations.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app, and continued use after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction, subject to any non-excludable rights.
